SecureNetFiber Terms of Use

These Terms of Use (“Agreement”) govern your access to and use of SecureNetFiber.com and all associated websites (“Site”) operated by WV AirNet, LLC d/b/a SecureNet (“SecureNet,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by this Agreement, along with our Privacy Policy, Terms of Service, Open Internet Policy, Acceptable Use Policy, and any other policies referenced herein.

1. Acceptance of Terms

You agree to indemnify, defend, and hold harmless SecureNet, its affiliates, employees, agents, licensors and representatives from any claim, damage, loss, liability, cost or expense (including attorneys’ fees) arising from or related to:

• Your violation of this Agreement;
• Your violation of any law or third-party rights;
• Content you post or transmit via the Site.

8. Disclaimer of Warranties

• The Site is provided “as is” and “as available.” SecureNet makes no warranties, express or implied, regarding site availability, accuracy of content, or that the Site will meet your requirements.
• We disclaim implicit warranties of merchantability, fitness for a particular purpose, non-infringement, or any other implied warranties to the extent permitted by law.

9. Limitation of Liability

• To the fullest extent permitted by law, SecureNet and its affiliates will not be liable for any indirect, incidental, special, punitive, or consequential damages arising out of or in connection with your use of the Site, even if advised of the possibility of such damages.
• In jurisdictions where these disclaimers or exclusions are not permitted, some or all such liabilities may be limited.

10. Governing Law & Venue

• This Agreement is governed by the laws of the State of West Virginia, without regard to its conflict of law principles.
• Any dispute arising from or related to these Terms of Use shall be resolved in the state or federal courts located in Kanawha County, West Virginia, and you consent to venue and jurisdiction there.

11. Severability

If any part of this Agreement is found to be invalid or unenforceable, that part will be enforced to the maximum extent permitted, and the remaining parts will remain in full force and effect.

12. Entire Agreement

These Terms of Use, together with referenced policies (Privacy Policy, Terms of Service, Acceptable Use Policy, etc.), constitute the entire agreement between you and SecureNet regarding your use of the Site, superseding any prior or contemporaneous communications or agreements.
