SecureNet Terms of Service

These Terms of Service (“Service Agreement” or “Agreement”) are between SecureNet Fiber, LLC (“SecureNet,” “we,” “us,” or “our”) and the subscriber (“you,” “your,” or “Subscriber”) for the provision of fiber Internet access service and any associated voice, data, or ancillary services (collectively, the “Services”) at SecureNetFiber.com.

If you subscribe to or use our Services, you agree to this Service Agreement, including all documents incorporated by reference (Privacy Policy, Open Internet Policy, Acceptable Use Policy, equipment policies, etc.). If you don’t agree with these terms, you should not use or subscribe to our Services.

  1. Eligibility & Acceptance
  • You represent that you are of legal age to enter into a binding contract, or if a business entity, that the person signing has authority.
  • By subscribing, installing, or using the Services, you accept and agree to abide by all terms here and related policies.
  1. Term & Renewal
  • Residential Internet plans are typically month-to-month, unless otherwise stated.
  • Commercial/business plans may require a longer term (e.g. 1-2 years), as specified in your service order or quote.
  • Plan renewal or continuation occurs at the end of the term, under the then-current rates and policies, unless you or we give notice otherwise.
  1. Fees, Installation & Payment Terms
  • Installation Fee: You will pay an installation/activation fee, which may vary depending on location and the complexity of connecting your premises to our fiber network.
  • Initial Payment: At or before installation, you must pay the installation fee, first month’s service, and any other required charges.
  • Monthly Fees: After installation, you pay applicable monthly charges, fees, and charges for any additional services. Payment is due on or by a specified date each billing cycle.
  • Late Payments: If a payment is overdue, we may assess late fees, suspend or terminate service, and require reactivation or reconnection fees. You’ll also be responsible for any collection costs.
  • Taxes and Fees: You are responsible for all applicable federal, state, and local taxes, fees, and charges imposed on the Services.
  1. Equipment
  • SecureNet may provide network equipment (e.g. ONT, router, CPE) necessary to deliver fiber service. This equipment remains SecureNet’s property.
  • You may use your own equipment if it meets SecureNet’s technical standards, does not harm the network, and is approved by SecureNet.
  • You agree not to tamper with, modify, or damage SecureNet-owned equipment. Upon termination of your service, you must return all SecureNet equipment in good working order (ordinary wear & tear excepted). If you fail to return equipment, you may be charged replacement fees.
  1. Subscriber Obligations
  • You must ensure your premises permit installation and usage of required equipment. You are responsible for any permits, landlord/HOA approvals, or compliance with building codes.
  • You must provide certain utilities (power, etc.) for SecureNet equipment.
  • Maintain accurate contact, billing, and payment information. Notify us of changes.
  • Use the Services in compliance with all policies (Acceptable Use, Open Internet), applicable law, and not engage in harmful, infringing, or illegal activity.
  • You are responsible for all use of your service/equipment, including by others you allow to access it.
  1. Service Standards & Outages
  • SecureNet aims to provide reliable, high-capacity fiber service. Speeds, latency, and service quality are as advertised, but real performance can vary (e.g. in-home wiring, devices, outside network conditions).
  • If there is an outage (for example, you cannot send or receive data through our network and notify us), we may offer service credits under certain conditions (e.g. duration of outage, cause being within our control). The resolution will not exceed your monthly service fee for that period.
  1. Acceptable Use & Prohibited Activity
  • You agree not to use the Services for unlawful purposes, spam, infringement, distributing malware, hacking, or other harmful or abusive behavior.
  • You must respect SecureNet network integrity, not overload, misuse, or interfere with other users.
  • You may not resell or redistribute your service unless expressly permitted under a reseller agreement.
  1. Termination & Suspension
  • We may suspend or terminate your service for non-payment, breach of any material term, illegal use, or for violating these Terms or incorporated policies.
  • You may terminate by giving notice (email or written) per the terms of your service plan. You will remain responsible for all charges through the date of termination.
  • Early Termination Fee: If you cancel service within the first 90 days and SecureNet has completed any installation work or drop installation to your premises, you will be charged an early termination fee of $200. This fee reflects costs associated with construction and setup.
  • Equipment Return: Upon termination for any reason, you must return all SecureNet-owned equipment (e.g. ONT, router, or other provided devices) in good working condition within 15 days. Failure to return equipment will result in replacement charges up to the full retail value of the equipment.
  1. Disclaimers & Warranties
  • The Services and equipment are provided “as is” and “as available.” SecureNet makes no warranties beyond what may be expressly stated.
  • We do not guarantee uninterrupted or error-free service, or that service will meet all expectations.
  1. Limitation of Liability
  • To the extent allowed by law, SecureNet and its related entities will not be liable for indirect, incidental, special, punitive, or consequential damages, data loss, or issues outside our control.
  • The maximum liability SecureNet would have in any dispute shall not exceed a specified amount (e.g. monthly service charges) or other legally permissible cap.
  1. Dispute Resolution & Arbitration
  • Disputes between you and SecureNet will be resolved via arbitration (if permitted under your state law). You waive the right to a jury trial or class action, except where not allowed by applicable law.
  • Arbitration procedures, notices, and process will be laid out in more detail in the arbitration section.
  1. Indemnification
  • You agree to indemnify, defend, and hold harmless SecureNet and its affiliates for any claims, damages, or expenses (including attorneys’ fees) arising from your misuse of the service or breach of this Agreement.
  1. Governing Law & Venue
  • The Agreement will be governed by the laws of the state where your service is provided or where SecureNet is headquartered (unless law provides otherwise).
  • Any legal proceedings or claims you bring must be in the courts or arbitration of that jurisdiction.
  1. General Provisions
  • This Agreement, along with Privacy Policy, Open Internet Policy, and any other policies/appendices, form the entire agreement concerning your service. It supersedes earlier verbal or written statements.
  • SecureNet may update or amend terms, policies, rates, and features. We will provide notice of material changes via posting on our website and/or other legally required methods. Your continued use of Services constitutes acceptance of amended terms.
  • Notices: how we communicate important information to you (email, postal mail, website notices) and how you may contact us.
  1. Miscellaneous
  • Force Majeure: SecureNet is not responsible for performance delays due to causes beyond our reasonable control (e.g. natural disasters, utility failures, etc.).
  • Severability: If any section of this Agreement is deemed invalid/unenforceable, the rest remains in force.
